Terms & Conditions

These Terms and Conditions apply to photography services provided by LucidLens Studio (“LucidLens”, “we”, “us” or “our”).

By accepting a quotation, paying a booking fee or confirming a photography session, you agree to these Terms and Conditions. Any quotation or booking agreement issued for a specific project also forms part of the agreement.

Nothing in these Terms affects any mandatory rights available to consumers under Irish law.

1. Bookings

A booking is confirmed only when:

  • The quotation has been accepted in writing;
  • Any required booking information has been provided; and
  • The applicable booking fee has been received.

Until then, the requested date remains available to other clients.

Quotations are valid for 30 days unless otherwise stated. Any material change to the date, location, duration, number of participants, deliverables or intended image usage may require a revised quotation.

2. Booking fee and payment

A booking fee of €150, or another amount stated in the quotation, may be required to secure the agreed date.

The booking fee will be deducted from the total amount due unless otherwise stated. It covers reservation of the date and initial administration and planning.

The remaining balance must be paid according to the schedule shown in the quotation or invoice. Final high-resolution images and usage rights may be withheld until all outstanding amounts have been paid.

Additional photography time, images, travel, studio or venue hire, permits, advanced retouching and other services outside the original quotation may be charged separately.

3. Consumer cancellation rights

Consumers who book by email, telephone or online may have the right to cancel within 14 days of entering the service contract.

Cancellation must be communicated clearly in writing.

Where you ask us to begin planning or providing services during this 14-day period, you may be charged a proportionate amount for work already completed if you later cancel. If the service has been fully performed following your express request, the right to cancel may no longer apply.

This section does not limit any other statutory rights available under Irish consumer law.

4. Cancellations and rescheduling

Outside any applicable statutory cancellation period, cancellation or rescheduling requests must be made in writing.

Unless a quotation states otherwise:

  • More than 14 days before the session: the booking fee may be retained;
  • Between 7 and 14 days before the session: up to 50% of the agreed fee may be payable;
  • Less than 7 days before the session: up to 100% of the agreed fee may be payable.

Any amount charged will reflect planning already completed, costs incurred, time reserved and the likelihood of replacing the booking. It is not intended as a penalty.

One rescheduling request may be accommodated subject to availability. Further changes may require a new booking fee.

If LucidLens cannot complete the booking because of illness, emergency or circumstances outside our reasonable control, we will offer a suitable replacement photographer, an alternative date or a refund for services that cannot be provided.

5. Client responsibilities

You must provide accurate information about:

  • The purpose and intended use of the photography;
  • The required images and important moments;
  • The location, schedule and number of participants;
  • Access, safety or venue restrictions;
  • Privacy, confidentiality or safeguarding requirements.

You are responsible for securing any necessary location permissions and paying venue, permit, parking or access charges unless these are expressly included in the quotation.

Where you are booking on behalf of a business, organisation or event, you are responsible for informing relevant participants that photography will take place and for obtaining any permissions required for your intended use of the images.

Participants must be ready and available at the agreed time. Delays may reduce the available photography time, and additional coverage may be charged separately.

6. Creative approach and image selection

By booking LucidLens, you confirm that you have reviewed our portfolio and understand our photographic and editing style.

We will follow the agreed brief while retaining professional and creative discretion over matters such as:

  • Lighting and composition;
  • Direction and posing;
  • Framing and cropping;
  • Image selection;
  • Colour treatment and retouching.

We will use reasonable efforts to capture requested photographs, but cannot guarantee every individual image, expression, participant or moment, particularly where circumstances are outside our control.

Unless otherwise agreed, LucidLens will select the strongest images for final delivery. Not every photograph taken will be supplied.

7. Editing and RAW files

Final images receive professional editing consistent with the LucidLens portfolio.

Standard editing may include exposure and colour correction, cropping, minor blemish retouching and basic background clean-up.

Advanced retouching, body reshaping, complex object removal, compositing or other substantial alterations are not included unless specified in the quotation.

RAW files, unedited photographs, rejected images and working files are not included and remain the property of LucidLens.

8. Delivery and storage

The estimated delivery timeframe and number of final images will be stated in the quotation or booking agreement.

Images will normally be delivered through a private online gallery or secure digital transfer. Unless expressly guaranteed in writing, turnaround times are estimates.

Online galleries will normally remain available for 90 days. You are responsible for downloading and securely backing up your images before the gallery expires.

LucidLens will take reasonable care when storing project files but does not provide permanent archiving. Final images may be deleted after 12 months, and RAW or working files may be deleted earlier.

Any technical issue or failure to meet the written brief should be reported within 14 days of delivery. Genuine processing errors will be corrected within a reasonable period. Additional changes or changes of preference may be charged separately.

9. Copyright

Copyright in all photographs remains with LucidLens Studio unless it is expressly transferred through a separate written agreement.

Payment for photography services does not transfer copyright ownership. Under Irish copyright principles, copyright generally arises automatically when an original work is created, and the photographer is ordinarily the owner of copyright in a photograph.

You receive a licence to use the final delivered images in accordance with these Terms and the relevant quotation.

10. Image usage licence

Unless the quotation states otherwise, business clients receive a non-exclusive licence to use the final images for their own:

  • Website;
  • Organic social media;
  • Company profiles;
  • Internal communications and presentations;
  • Press and public relations;
  • Recruitment;
  • Printed brochures and general marketing materials.

Individuals purchasing headshots or personal-branding photography may use the final images on their personal website, CV, LinkedIn, professional profiles, social media and press or speaker profiles.

The standard licence does not automatically include:

  • Paid advertising campaigns;
  • Packaging or merchandise;
  • Resale or stock-library submission;
  • Use by unrelated third parties;
  • Transfer or sublicensing;
  • Artificial-intelligence training;
  • Political, defamatory, misleading or unlawful use.

Extended commercial usage may require written approval and an additional licence fee.

You may provide the images to your designer, printer, agency or publisher only to produce authorised materials on your behalf.

The licence takes effect only after the relevant invoice has been paid in full.

11. Portfolio use and identifiable images

LucidLens will not automatically use identifiable client photographs for its own marketing simply because a session has been booked.

Where appropriate, permission for portfolio or promotional use will be requested separately. If permission is granted, selected images may be used on our website, social media, printed portfolio, exhibitions or other promotional materials.

You may withdraw consent for future portfolio use by contacting us. Withdrawal will not affect lawful use that occurred before it was withdrawn or materials already printed or distributed.

Photographs of identifiable individuals are personal data, and their capture and subsequent use must have an appropriate legal basis.

12. Event photography

Event photography may include candid and background images of attendees, employees, speakers and guests.

The event organiser is responsible for:

  • Giving appropriate notice that photography will take place;
  • Identifying anyone who should not be photographed;
  • Informing us of private or restricted areas;
  • Establishing an appropriate basis for its intended use of the photographs.

We will use reasonable efforts to respect clearly communicated objections but cannot guarantee that an individual will never appear incidentally in a crowd or background image.

13. Liability

LucidLens will provide the services with reasonable care and skill.

We are not responsible for missed photographs, delays or reduced coverage caused by late or unavailable participants, venue restrictions, unsafe conditions, incorrect client information, weather or other events outside our reasonable control.

Nothing in these Terms excludes liability that cannot legally be excluded, including liability for fraud, deliberate misconduct, death or personal injury caused by negligence, or mandatory consumer rights.

For business clients, our total liability arising from a booking will not exceed the total amount paid for that booking, except where such a limitation would be unlawful.

14. Privacy, law and contact

Personal information and identifiable photographs will be processed in accordance with the LucidLens Studio Privacy Policy and applicable data-protection law.

These Terms and all bookings are governed by the laws of Ireland. The Irish courts will have jurisdiction, subject to any mandatory rights available to consumers.
